Abstract

The aim of this research is to analyze and criticize the regulation of legal certainty for owners of land ownership certificates from a legislative perspective and to analyze and criticize the legal consequences of land executions which are different from the object of the case of cancellation of land ownership certificates which have permanent legal force. . In this research the author uses normative juridical research methods, in conducting a study of the law. The results of this research that the author can provide are, to resolve the case problems listed in the Supreme Court decision Number RI Supreme Court Decision Reg. No. 353 PK/Pdt/2010 dated 15 December 2010. The land execution that was decided in the trial was carried out by the Plaintiff as the winner of the case, however the land object executed by the Plaintiff did not match the land object mentioned in the trial. The legal consequences of land execution are different from the object of the case of canceling a certificate of ownership of land which has permanent legal force, namely that there is no legal certainty of ownership of the land because the court carried out the execution wrongly, therefore it is necessary to cancel the decision made by the court in order to restore the rights. ownership of their land. to realize legal certainty in every transfer of land rights.
