Juridical Analysis of Deeds of Rental Agreements as a Legal Basis for Church Operations in Shophouses, Multipurpose Rooms, or Malls

Abstract

The purpose of this research is to provide knowledge and views from a legal perspective regarding the certainty and legal consequences of notarial deeds for churches that enter into rental agreements with building owners with the aim of making the multi-purpose room a house of worship, in this case the church according to invitational laws and regulations that apply in Indonesia. The type of research used in this article is normative legal research which is carried out by reviewing applicable laws and regulations. Based on the research results, the following conclusions can be formulated: (1) Legal certainty regarding churches that do not stand on their own buildings is not a legal object of the Joint Regulation of the Minister of Religion. Churches that stand in malls, multi-purpose rooms or malls do not have legal certainty. (2) It is recommended that the definition of a house of worship be expanded considering that today's houses of worship do not only stand on private land so that places of worship that stand in malls and hotels can also be legally registered and have permits for their operations.
