Abstract

ABSTRACT

 

This study aims to 1) determine and analyze the supervisory authority of the Regional Representative Council (DPD) over the Draft Regional Regulation (Ranperda); 2) determine and analyze the legal implications of the supervision of the Regional Representative Council (DPD) over the Draft Regional Regulation (Ranperda). The research method used is the normative legal research method and the approaches used are the legislative approach and the conceptual approach and the case approach. The analysis of the legal materials used in this study was carried out by interpreting, evaluating and assessing all laws and regulations and assessing relevant legal materials. The results of the study indicate that 1) The supervisory authority of the Regional Representative Council (DPD) over the Draft Regional Regulation (Ranperda) is contrary to the constitution Article 22D of the 1945 Constitution of the Republic of Indonesia and also conflicts with the authority held by the central government as regulated in Law Number 23 of 2014 concerning Regional Government. Article 249 of Law Number 2 of 2018 does not explicitly and clearly regulate the mechanism and implications of supervision by the Regional Representative Council (DPD) on Draft Regional Regulations (Raperda); 2) The legal implications of supervision by the Regional Representative Council (DPD) on Draft Regional Regulations (Ranperda) are that 1) the authority to supervise draft Regional Regulations in the Indonesian legal system is a supervisory authority that was initially known in the form of preventive supervision. This supervision is currently implemented through the evaluation mechanism for draft Regional Regulations.
